The following is the contractual document that will govern the contracting of services through the website www.menumaker.es, property of Busanmat S.L. (hereinafter the provider). The acceptance of this document implies that the user:
a. You've read, you understand and you're agree with this text, including all terms and conditions.
b. That you are a person with sufficient capacity to contract.
c. That assumes all the obligations established in this document.
These conditions will have an indefinite period of validity and will be applicable to all hirings and purchases made through the website www.menumaker.es.
The provider reserves the right to unilaterally modify these Conditions, without affecting the goods or promotions that were acquired prior to the modification.
On the one hand, the supplier of the goods or services contracted by the user is Busanmat S.L., with registered office Calle Txakursolo 4, 48992, Getxo, C.I.F. 946615257, and on the other hand,
The user, registered in the website through a username and password, over which he has full responsibility for use and custody, being liable for the veracity of the personal data provided to the provider.
The purpose of this contract is to regulate the contractual relationship of purchase and sale born between the provider and the user at the moment when the user accepts the corresponding field during the online contracting process.
The contractual relationship of purchase involves the delivery, in exchange for a specific price and publicly exposed through the website, of a specific service.
The contract procedure can only be carried out in the Spanish language. In case it could be carried out in another language it will be indicated before starting the contracting procedure.
The user, in order to access the services offered by the provider, must register through the website through the creation of a user account. To do this, the user must provide freely and voluntarily the personal data that will be required.
The user will select a username and password, committing to make diligent use of them, and not make them available to third parties, as well as to notify the provider of the loss or theft of this data or possible access by an unauthorized third party, so that it proceeds to the immediate blockade.
The user cannot choose as user name words that have the purpose of confusing others, as well as expressions that are abusive, insulting and, in general, contrary to the law or the demands of morality and good manners.
Once the user account has been created, it is informed that in accordance with the requirements of art. 27 of Law 34/2002 on "Servicios de la Sociedad de la Información y del Comercio Electrónico", the contracting procedure will follow the following steps:,
1. Choice of the plan. Currently, two payment plans are available:
- 1st: plan of € 9.90 per month.
- 2nd: plan starting at € 15 a month, with increments of € 5 per month, depending on the number of restaurants you want to have premium subscription for wannamenu.com.
2. Introduction of the billing information and the data of the credit / debit card. MenuMaker does not save the data of the card in its servers. The specialized platform Stripe is liable for this entire process, stripe.com.
In any case, the hiring platform of the provider will inform the user, once the hiring procedure is finished, via e-mail, regarding all the characteristics of the contracted service.
The prices indicated for each service include the Value Added Tax (VAT) or other taxes that may be applicable and in any case be expressed in the Euro currency (€).
The prices applicable to each service will be those published on the website and applied automatically by the contracting process in the last phase of the same. The client assumes that in any case the economic valuation of some of the services may vary in real time. In any case, this will always be previously communicated to the users.
Any payment made to the provider will involve the issuance of an invoice in the name of the registered user. This invoice can be downloaded automatically from the following address:www.menumaker.es/me/invoice.
For any information about the order, the user will have the customer service telephone number of the provider that is 687474362 or via email to the e-mail address info@menumaker.es. In any case, the order number that was assigned and indicated in the confirmation email of the purchase must be indicated in the subject of the message or to the teleoperator.
Once the payment is completed, the refund will not be possible.
The minimum stay when activating a plan will be 1 month. After this period, if the subscription has not been canceled, the subscription will be renewed automatically and a new charge will be issued to the account provided by the client.
The customer may cancel the subscription to the monthly service at any time from the following address: www.menumaker.es/me/plan, by clicking on the text "Cancel subscription". Menumaker will leave from this moment to issue charges to the client's account.
The client will be able to enjoy the services of the acquired plan until the date of termination of said plan, which will be displayed at the addresswww.menumaker.es/me/plan
After this date, the subscription will be automatically canceled.These conditions will be governed or interpreted in accordance with Spanish legislation in matters not expressly established. The provider and the user, agree to submit any dispute that may arise from the provision of the services subject of these Conditions, to the Courts and Tribunals of the user's address.
In the event that the user has his domicile outside of Spain, the provider and the user, expressly waive any other forum, submitting to the Courts and Tribunals of the city of Barcelona (Spain).
